HEIRARCHY
PRESIDENT:
Before we discuss the president and his roles, we need to understand the executive committee. It is the executive board of an MC, consisting of officers and important rank holders. The committee is tasked with making the most important decisions, overseeing daily operations, and addressing urgent matters. Returning to the president, he is the CEO of a motorcycle club. A president deals with all the business relationships and dealings on behalf of the motorcycle club. He acts as a bridge to communicate with law enforcement agencies and other motorcycle clubs. Whatever the matter is between the club and other entities, it is brought to the president’s knowledge, and his decisions are considered final. It is also the president’s responsibility to make sure that the club's activities are as per the agreed rules and manifesto. He is only called in for voting, where he can either break a tie vote or make it a tie.
VICE-PRESIDENT:
The vice president has the power of a president in his absence. He works as an acting president of the motorcycle club if the president can’t make it to a meeting or a discussion. A vice president has an active role as he supervises the tasks, plans, and events. If the motorcycle club or the committee has any issues, they are first brought to the vice president. A vice president of a motorcycle club also acts as a bridge between the president and motorcycle club members. He passes on the information from the highest authority to the club members.
SERGEANT-AT-ARMS:
The sergeant at arms (SGT at arms) is the primary enforcer and the sole bodyguard to the president of the motorcycle club. He ensures that the members duly follow the club's rules and laws set by the leadership. He also checks that nothing goes against the club's rules. The sergeant at arms is one of the most active members of a club. One of his major tasks is to ensure the security and safety of all club members and prospects.
He is also tasked with bringing any security threat to the attention of the higher authority and the executive committee so that rapid action can be taken. The SGT at arms also deals with keeping the club's security data and keeping track of the members. He takes the club patch back in case a member retires, resigns, or is expelled.
The SGT at arms takes notice of every member's actions. If he finds anyone breaking the club’s rules, he takes strict notice and forwards the matter to the executive committee. The sergeant at arms also maintains law and order in a motorcycle club at the events, meetings, and other activities.
ROAD CAPTAIN:
A road captain is considered the boss of the motorcycle club on the road. Regardless of the many activities a motorcycle club performs, the group rides are still the essence of an MC. Therefore, they must be organized, safe, and accessible from brawls. This is what a road captain is tasked to do. If the president and vice president don’t participate in the group rides, the road captain assumes the authority role and organizes the ride's formation. Even if the president joins the ride, he leads the pack while riding at the front alongside the president. He acts as an SGT at arms while on the run, ensuring that the club rules and laws are duly followed. The road captain is also tasked to plan routes and locations for group rides.
SECRETARY:
The secretary of a motorcycle club is the record keeper. He keeps all the club records and takes notes of all the meetings organized by the club. He has all the data in written reports, even if it is a formal communication with external entities and other motorcycle clubs. A secretary is also in charge of maintaining the club's manifesto and constitution. Also, he is responsible for notifying the higher authority and executive committee if any changes need to be made to the club’s constitution. The secretary must also convey messages to members who were not present at a club meeting. He must also notify all the members about upcoming events and meetings so that everybody is present. A secretary also keeps track of prospects’ performances based on which they are judged and made the club members. A secretary also becomes the voice of the members to report any issue for the club's best interest. A secretary also performs the duties of a treasurer in his absence.
TREASURER:
As the name suggests, a treasure in a motorcycle club manages an MC's finances. He is in charge of dealing with the expenses and paying the club's bills. The treasurer is also responsible for collecting all the funds and income from various sources. A motorcycle club has different income sources depending on its size and preferences. It makes certain investments to run and can also take money from its members to operate. A treasurer accounts for all the assets and finances a motorcycle club holds. The financial record is presented or provided to the executive committee and leadership at the annual meetings. A treasurer is also in charge of collecting fines and dues from club members. The treasurer also ensures that all the financial requirements for organizing a charity ride or any other event are duly met. If he is not present, he acts as a secretary.
ENFORCER:
Enforcers, although not technically officers, are delegated are appointed and controlled by the sergeant at arms in a motorcycle club. They perform the same duties of maintaining peace and ensuring the safety of all club members on and off the road. If a motorcycle club has many members, an SGT at arms has the right to appoint enforcers to help him perform his duties effectively. Enforcers make sure that all members duly follow the club rules and laws. They are tasked to deal with any conflicts that can arise between members of different clubs. Enforcers are also responsible for keeping the MC’s reputation and stance as a priority.
TAIL GUNNER:
A tail gunner, NON-OFFICER position is also a very important rank in a motorcycle club, particularly when the group is in action. He performs his duties while riding at the back of the pack to ensure everything stays smooth and perfect. He supervises the group from the back while ensuring that the formation doesn’t break and no rider is left behind due to some issue. If someone in the group ride is left behind or facing a mechanical breakdown, the tail gunner should assist him. Whether it is fixing the bike issue or providing first aid to an injured rider, the tail gunner takes care of everything. He also communicates with the road captain to plan and organize the ride. A tail gunner assumes the role of the road captain when he cannot perform his duties. Any patched member can be delegated to this role during a ride-out.
MEMBERS:
Members are the essential parts and riders of the motorcycle club. They make the motorcycle club. Without the members, there will be no hierarchy or leadership. The members appoint the executive committee of the club. However, members are expected to prove their loyalty and perform their responsibilities with dedication to earn a higher rank.
PROSPECTS (PROBATES):
Prospects are like internees. Anyone interested in joining a certain motorcycle club must fulfill all the requirements specified by the club. Most motorcycle clubs interview aspirants, and when they clear the interview, they are referred to as prospects. Prospects must stay sincere and abide by all the club’s rules to earn a member badge. Becoming a member of a motorcycle club is no joke. It is a very hard-earned thing. They are expected to follow all the orders from the senior members. They are required to prove themselves to be worthy of earning a patch.
FOUNDER:
The founder is at the top of a motorcycle club's hierarchy. It is considered a special rank in an MC. The founder can be either one person or a group of people. If a founder is active in a motorcycle club and rides his/her motorcycle, he/she is likely to be the president of the club. If there are other co-founders, they will likely become the vice-presidents. An active founder has many crucial roles and responsibilities in a motorcycle club. First, he has the vote to cast in elections to appoint new officers and lead members. He is also involved in all the crucial gatherings, meetings, and events. If a founding member no longer serves in an officer position, they retain the right to vote on important matters of concern.
MOTORCYCLE CLUB BY-LAWS AND CONSTITUTIONAL AMENDMENTS
Article 1.
This club shall be known as: HAND OF DEATH MOTORCYCLE CLUB.
Article 2.
Active members shall be motorcycle riders or motorcycle enthusiasts. Honorary members shall be an individual, as the club decides by a two-thirds vote of those present at any regular meeting. Only active members shall be entitled to vote in club affairs. All members are required to have an active and valid PlayStation Network Account, A Discord Account, and a member of the Rockstar Games Social Club.
Article 3.
The officers of the club shall be president, vice president, secretary, treasurer, and prospect manager. The club might also include a risk management officer and/or chief legislative officer, as well as a road captain, enforcer, and/or trail boss, depending on the focus of the club’s activities. The officers of the club shall constitute the executive board.
Article 4.
The duties of the president shall be:
• To preside over all meetings of the club.
• To have general supervision of the affairs of the club.
• To establish short- and long-term goals for the club, in cooperation with other officers.
• To appoint any person or committee not otherwise ordered by the club.
• To personally represent the club on proper occasions and in business contracts.
• To assist all other officers of the club in their records, correspondence and other duties.
• To promote interest on the part of each member in club life and activities.
• To vote only when necessary to break a tie.
Article 5.
The duties of the vice president shall be:
• To perform the duties of the president in his/her absence.
• To coordinate committees and manage programs for the club.
• To provide complete oversight on all club affairs
Article 6.
The duties of the secretary shall be:
• To keep accurate minutes of meetings.
• To handle member applications, records, supplies and update various club documents, as necessary.
• To maintain club constitution and/or bylaws.
• To send out notices of regular or special meetings.
• To handle club correspondence and administrative details.
• To perform such other duties as generally fall to that office.
Article 7.
The duties of the treasurer shall be:
• To maintain club financial records and deliver reports on a timely basis.
• To send and receive club money.
• To ensure there is more than one signatory on the bank account.
• To file the club tax return, if applicable.
• To have a team perform a yearly financial audit.
• To research and facilitate all heists, missions, or events that will ultimately generate financial earnings for all members.
Article 8.
The duties of the Sergeant-At-Arms shall be:
• To maintain order and discipline within the club as a whole; both members and officers alike.
• To enforce all club by-laws, rules, regulations, and any amendments passed by proper legislation within the MC.
• To maintain the club’s arsenal, and serve as the frontline lead for any combat operations or wars against any rival organizations and or common enemies as identified.
• To appoint and manage all enforcers and provide oversight to any operations conducted and approved by the executive committee (Officers).
Article 9.
The duties of the Road Captain Shall be:
• To lead the planning of club rides, including the route.
• To ensure safety and promote group riding best practices.
Article 10.
The duties of the Tail Gunner Shall be:
• To provide rear security during club rides
• To monitor all riders in the formation from the rear and provide rear clearance for oncoming traffic
• To receive and execute all orders given by the Road Captain.
Article 11.
The duties of the Prospect and Recruit Manager shall be:
• To exercise the authority to do direct recruiting campaigns for all incoming personnel; and to establish roles and sponsor each person as a hang-around, or prospect.
• To exercise their authority to determine a prospect or hang-around probationary or trial period prior to requesting a council vote to promote the prospect to full patch membership.
• To represent each prospect and bring any issues or concerns that they may have before the council for deliberation in order to reach a final disposition or action concerning such.
• To create, manage, and execute all marketing campaigns for recruiting purposes.
Article 12.
All elective offices shall be filled at an election to be held on _JAN 2ND____ of each year. All officers shall hold office for one year or until their successors are elected and qualified. Maximum terms for officers shall be __1__ years.
Article 13.
The constitution may be amended, providing the proposed amendment is submitted in writing at a regular meeting. It shall then be advertised for ___2__ weeks and voted on at the next meeting. A two-thirds vote of all active members in good standing shall be required to pass an amendment.
AMENDMENTS
Rule 1:
Real-Time Commitments are and shall always supersede everything else. Members shall have the right to prioritize personal responsibilities; real-time circumstances, events, or in any case involving such. Members shall exercise this right accordingly with no prejudice imposed by any member, including elected officers. Prolonged in-activity without notice can and may lead to demotion; and or removal to maintain the Club’s activity levels and interests, but upon legitimate due-process whereby attempts shall be made to establish communications with members in question, thus allowing a fair and impartial approach to determine such member’s status in order to determine the best approach for the member and the welfare of the Club. The Sergeant-At-Arms; along with the Vice-President shall have the power to enforce this amendment and final dispositions shall be ruled and carried out by a majority vote imposed by the elected officers.
Rule 2:
Regular meetings and “Church Days” are essential for coordination and community participation. All fully patched members and prospects must attend unless any real-time circumstances that arise that are supported and protected by Rule 1 shall apply, when communication and notices are establish with any of the elected officers. Accountability and Communication are essential to the Club’s interests and therefore, any member who cannot attend any meetings, events, etc. must make a legitimate effort to notify any elected officer to inform them of their intent. During “Church Days,” the following shall apply (Club Patches Must be Worn at all times during these occasions, Must Ride A Motorcycle without any weapons, mods, or arsenal or any sort, No weapons Shall be drawn or used during these events unless specifically endorsed by the elected officers depending on the type of event, No cars shall be driven during these events, unless it is a Music Truck to facilitate any party events or luxury transportation such as a limo, plane, helicopter, or marine vessels if requested by the member who is facilitating the event).
Rule 3:
No Member to Member Killing! Friendly fire is strictly discouraged. If accidental during a gun fight with an opposing crew, members are encouraged to show proper courtesy and respect and render an apology or acknowledgment of the accident. Although accidents will always occur during gun fights, the Club wishes to promote respect within its ranks and there is no better way to do it other than acknowledge such incidents and take appropriate action to ensure each member that they are valued, respected, and exercised integrity for the well-being of the Club. Repeated offenses without remorse or acknowledgment of this amendment are grounds for delinquent action that may include revoked membership, demotion, and will be otherwise treated as a hostile player. Respect is everything, and each member is kindly requested to exercise these values in good faith.
Rule 4:
Interactions with Rival MCs or Hostile Parties. The Club wishes to acknowledge its wisdom and understanding that members may have had some affiliation or connections with other MCs or Crews that may have been labeled as rivals or enemies in any given lobby. Although fraternizations with these outside entities are discouraged, all members shall be given the right to exercise this prerogative with extreme caution and with due diligence. If any member is a friend, or an old associate of a crew they once belonged to; it shall be the member’s responsibility to communicate with that party to reach a neutrality state, parley, or form an alliance upon the approval of the elected officers from both sides. Otherwise, members are always advised and discouraged from any contact with any rivals in any given lobby. We are part of a gaming community, and as such, we should have no right to tell any member who they can and cannot play with it. Any disagreements on the matter may bring any issue or concerns to the table for discussion; thus, resulting in a possible vote to rule its final disposition to the matter at hand.
Rule 5:
Discrimination Policy. Any form of racism, insults, or discriminatory behavior shall result in immediate expulsion if any evidence on the matter is found undisputed. This rule is intended to foster a safe, friendly, fun, and inclusive environment for all members. If any member; is found to be or has incriminated themselves in being a part of a real-life criminal organization, committed any series crimes to include murder, rape, domestic violence, child abuse, drugs, or any crime that led to a conviction in any court of law (ALL JURISDICTIONS BASED ON GEOGRAPHICAL LOCATION) is grounds for immediate dismissal. All members are encouraged to report any information that has been shared with regards to such so that the elected officers may exercise their authority to remove the individual in question to maintain the integrity of the Club, the safety of its members, and foster a safe gaming environment. If the club is connected to such individuals who are unfortunate to be in that position, WE ARE ALL GUILTY BY ASSOCIATION and shall not be tolerated.
A rule is adopted that no member; officers, patched-members, prospects, or any affiliates exhibit or promote political stands, beliefs, or otherwise engage in any forms of hate, slander, or discrimination against any state, government, country, religion, or social standing in any form to include social media platforms that shares our club image, logos, events, photos, videos, or documentation. This rule is applied to foster a friendly gaming environment for all; considering that all members are from around the world and all are invited to join who share a mutual core value and common interest. All member opinions are respected with regards to their own personal beliefs and are entitled to their opinions. However, to maintain a friendly atmosphere, we hereby adopt this rule to be effective and enforced by all.
Rule 6:
Brotherhood above All Policy. All members must prioritize mutual support across the Club as a whole. All disputes are to be resolved swiftly to maintain harmony within the MC; and shall be done with humility, respect, and class. Disagreements may arise within the ranks, and it is a normal part of life whether it is inside or outside of our virtually immersed community. Members are required to always treat each other with respect during an internal conflict or general disagreements with any plans, approach, or activities set forth. No exceptions! We are here to promote a fun and safe gaming environment for all our members.
Rule 7:
Any full-patch member can petition and sponsor a new player to prospect for HDMC. Prospects must wait to be fully patched before exercising this privilege; however, may ask any full patch member to vouch on their behalf. Prospect period shall be exercised “up to two weeks” to allow officers to play with and observe the candidate to determine fitness and suitability to dawn a full patch. Prospecting is a probationary role, and it must be exercised as such. If any officer deems that a prospect is ready to be patched prior to the two-week threshold may bring the matter to the table for a vote. When the prospect is voted on, officers may vote no or need more time to observe to validate the candidate’s qualification based on performance and behavior thus aligning with our core values under these bylaws.
Rule 8:
HDMC Charter Officers reserve the right to promote their own events, hierarchy, and overall club functions. It is imperative that all charters maintain their affairs under these bylaws. The Los Santos Chapter is the MOTHER CHARTER for all HAND OF DEATH MC patch holders and serves as the lead hierarchy of this organization.
Newly formed charters may be organized under the approval of existing charter officers and the officers of the mother charter. Currently, the HDMC will hold charters based on the adopted or seized territories and have a “NOMAD” section in place to conduct business on any of the charter’s behalf and instruction.
Rule 9:
Any event sanctioned by the Club shall bear certain rules. During a formal group ride or events opened to the public or alliance members; all members MUST WEAR THE PATCH. Although it is encouraged to wear the vest (CUT, or KUTTE), jackets, etc. … members are free to wear whatever attire if it can carry our CLUB LOGO. Officers shall give instructions prior to any event to reinforce this requirement.
During a formal club ride, members ARE NOT ALLOWED to use aircraft, cars, trucks, or any weaponized vehicles. Personal weapons are also not allowed to be drawn during these events. Fireworks are allowed dependent on the event, but NO WEAPONS.
Any other vehicles used during an event shall be approved by the officers depending on the mission. For example, funeral rides, armored escorts using vans, trucks, tanks, or weaponized vehicles shall be given instruction from the lead member who is hosting the event or mission.
Rule 10:
All must adhere to the ALLIANCE BYLAWS. No member is allowed to promote retaliation against any enemy without consulting with your respected officers in your club.
